Supreme Court stays Allahabad High Court order asking EC to order Suar Assembly bye-election, relief for Azam Khan’s son
New Delhi, November 07, 2020: The Supreme Court has provided relief to Abdullah Azam Khan, son of Samajwadi Party MP Azam Khan. Abdullah Azam Khan had said that the Allahabad High Court had displayed “unusual haste” in asking the Election Commission to order bye-election to the Suar assembly seat. Yesterday, the top court put an interim stay on the high court order.
The Allahabad High Court had canceled the election of Abdullah Azam. Then the court ordered a by-election. Abdullah challenged it in the Supreme Court. Abdullah Azam Khan has also challenged the Allahabad High Court’s decision to repeal the legislature in the Supreme Court. In January this year, Abdullah did not get any relief from the Supreme Court.The Court refused to stay the High Court’s decision to cancel the election. The High Court had quashed Abdullah Azam Khan’s legislature saying that in 2017, his age was below the age of 25 years for contesting elections. Abdullah Azam Khan had approached the Supreme Court against this decision.
Nawab Kazim Ali, the Bahujan Samaj Party candidate, had filed an Application against Abdullah’s election. Ali in his Petition Accused Abdullah of contesting elections with the help of fake documents. According to Ali, Khan has two documents of birth.
